Each property in Oakwood Estate contains a condition in its title deed requiring the Home Owners Association (HOA) to issue its formal Consent to the transfer of the property following a sale or change in ownership of the property.
In order to issue the Consent, the mandate of the HOA is to ensure that:
The HOA’s Managing Agents (Sandak Lewin Trust) will issue figures for payment prior to the issue of the Consent. This is usually a component of the conveyancing process, and will be requested of the Managing Agents by your conveyancer.
In order for the property to be certified fully compliant with both the Design Manual and the Environmental Guidelines, the seller/transferor will be obliged to submit a current set of approved building plans to the Estate Architect (Peter Frankenfeld of Frankenfeld & King – details below) for scrutiny and an on-site inspection at the property will need to be arranged with the Estate Architect or a representative from his offices.
The HOA will pay the Estate Architect fee for the inspection and report to follow (please obtain the current rate charged by the Frankenfeld & King in advance) to attend to the aforegoing scrutiny and inspection. The fee will be added to the seller’s levy account.
Where the property is compliant with the prescribed Estate Design Manual and Environmental Guidelines, the Estate Architect will confirm this to the Managing Agents.
In the event that the aforesaid scrutiny and inspection uncover issues of non-compliance, these will need to be appropriately remedied prior to the issue of the Consent to Transfer. Once remedied, a further on-site inspection from the Estate Architect will be necessary, which will be billed at a rate as stipulated by Frankenfeld & King (and at the same rate for each subsequent on-site inspection necessary).
Home Owners are encouraged to take note of the procedure outlined above, and to ensure that their building plans are fully approved (by both The HOA and the City of Cape Town). Home Owners contemplating the sale of their property(ies) should engage the Estate Architect and the managing agents, as well as the Estate Manager, as soon as a sale or transfer is contemplated in order to avoid potential delays in the transfer process should a compliance item need to be addressed.
All purchasers shall be required to complete the Acknowledgement & Undertaking document duly signed and returned to Sandak Lewin Trust, together with a copy emailed to the Estate Manager. No Consent to Transfer will be issued without receipt of the signed Acknowledgement & Undertaking document.
